I came to the US on F1 for MS and then trasferred to another college to pursue my PhD. During this time my F1 visa expired, but I am maintaining my legal status as my I-20 is valid. I got married last year and my wife who originally came on F1, is now on H1.
I am going to planning to go to India in end of April and need to renew my F1 visa. What are the chances of my renewal getting refused, due to my wife's H1 (dual intention) status? What documents if any, can I show in order to prove that I have intentions to come back to the US?
I need to get a visa interview date soon, so please reply as soon as is convenient.
Thanks in advance!

Just couple of days ago immigration-law.com reported about IV and its efforts to bring relief to high skilled community and 2 days later the site gets hacked. I wonder if anti-immigrants have anything to do with it ...... they may be really scared to IV :D

I worked with them for almost a year and ran like anything.
They were paying me meager salary even I had a good rate.
They started GC when I asked, which was good
There health insurance sucked
They reduced my salary at the last moment when I gave notice to my last employer. Agreed to give a raise after 6 monhts, never did. When I asked again after 1 year, they wanted to give me 2K raise which was nothing. This was after end client raised the rate by $5/hr
Owner/sales guy are amway, they'll ask you to go to there meetings. Somehow, i saved myself :)
When I left, they canceled my health insurance from a month back even when they have deducted premium from my salary. When I threatened to log a case with DOL then they gave the money (which they deducted) back. Still, I had to pay medical expense for that month (fortunetly it was less then the premium)

Hi,
Need quick suggestion:
Company A filed for GC. Labor and I-140 was approved. I-485 was filed during July 2007.
I changed employer in June 2009; replied to RFE and filed AC21 in July 2009.
I came to know that my GC sponsring company is going to close the company soon. My current immigration attorney is suggesting that if that happens; and if INS came to know that GC sponsring company is closing down, they will revoke my I-140.
Is it true? I thought after AC21 is invoked; whatever happens to GC sponsring company, it will not impact my GC application in any way.
Please advice.
V
Your I140 cannot be canceled/revoked unless USCIS detects that it was obtained fraudulently.
Your GC application will not be impacted. Just find another employer and join them with EAD.

This is just my opinion. If I were you, I will go to the Airport and see an Immigration Office and have it corrected.

Yes. I did contacted both Kerry and Brown's office last month (July end) for my EAD renewal application.
Both office staff were very receptive. Brown office has more than one person working on immigration matter....and I believe they were first to act on my case. I got EAD approval 4 days later.

My take and I am far from a lawyer.. so this is not legal advice...
You can study on H4
You cannot accept a scholarship
You cannot take an in-campus job
You cannot do an internship, apply for CPT or OPT's
If the above are all true.. there is no need to inform USCIS

I used my 485 EAD, which I received when I filed my 485 with my spouse. And now I want my employer to apply H-1B for me. I am wondering if I can apply change of status to H-1B within US or I have to apply H-1B petition, which requires me to get out of US and get the visa at some US consulate or embassy.
I'd really appreciate any info.
Thanks a lot.

The government has been ramping up enforcement of employment immigration laws, with a particular focus on insuring that companies are staying in compliance. The number of enforcement activities has increased dramatically in the past year. Now, more than ever, its important to insure that your company is ready in case of a government I-9 audit. And for the first time, its not enough to be in compliance. Each company must prove compliance, and if using an electronic system, use one that works in accordance with immigration laws.
The San Diego Union Tribune reports (http://signonsandiego.com/news/2010/oct/09/immigration-audits-are-increasing-against/), enforcement in San Diego County mirrors a national trend toward more scrutiny of employers I-9 forms, the universal tool for verifying permission to work in the United States.
Immigration and Customs Enforcement, or ICE, initiated 66 audits with local employers in the fiscal year ending Sept. 30, reviewing 5,588 individual I-9s in the process. That was up from 44 audits in fiscal 2009 and just one audit in 2008. A company can be fined up to $1,100 for each illegal employee, and knowingly violating verification laws can lead to criminal charges and forfeited assets.
So the heat is now on employers to clean the house, it is also a great burden on employees to find work. As the illegal population continues to grow, they will also find creative ways to deal with the system. All we can suggest employers is to conduct routine internal I-9 audits and have an immigration policy in place, this is the best practice to follow.

Now if I want to go back to Company A, do I need to transfer my H1B again?
Company A has not cancelled my H1 and I am in good terms with them.
Even if A didnt cancel H1 the comp A will have to apply for transfer.

Any expert can let me, can I apply L-1 Visa, if I am in USA in H-1B visa?
My company is Italian based Company and in USA they have a branch.
It is necessary that I have to be in outside USA to get L-1 Visa
